General Terms & Conditions

ACCEPTANCE OF CURRENT GENERAL SALES CONDITIONS
Confirming an order made on the Marie Louise de Bouteville website by an internet user (clicking on the "confirm order" button) implies full and complete acceptance of all the present general sales terms and conditions.
This contract is drawn up in accordance with French law. Full competence corresponds to the courts of the jurisdiction in which the Marie Louise de Bouteville official headquarters are based.

ORDERING
Once the buyer has placed an order, he is committed to the details given: the seller does not accept any responsibility for any errors in the delivery address provided, resulting in the non-delivery of goods.
Orders are not considered firm until the buyer has paid in full for them.
All our offers are valid only if there is stock available, without obligation and provided it has not been sold.
Considering that most of the products sold by Marie Louise de Bouteville are produced by artisans, it should be unreasonable to expect from them the rigueur of multinational companies.
The Marie Louise de Bouteville offers are solely available to private clients and in no case to any type of resellers or distributors in France or abroad, without Marie Louise de Bouteville consent. Marie Louise de Bouteville is therefore allowed to cancel any order that would not meet these criteria.

DELIVERY AND RECEIPT
The products are shipped carefully packed to be handed over in a single delivery at the same address for each order.
Marie Louise de Bouteville undertakes to deliver the goods in the shortest possible time. Average delivery times are detailed in product description, and may vary according to the country of destination selected by the customer.
Delivery will be made within the period forecasted directly to the addressee, or by means of notification if the client is absent.
Any possible delay does not give the buyer the right to cancel the sale, to reject the goods or to claim damages. Any delays resulting from war, uprisings, fire, strikes, accidents and the non-supplied products from the provider are considered to be due to Force Majeure, thereby releasing the seller from the obligation to make the delivery.
All liability for goods in transit corresponds to the addressee. Packages must be checked on arrival. Any damaged or missing goods from the shipping company must be claimed within 2 working days.

REJECTION OF GOODS
In accordance with the European consumer Code, the buyer has a period of 7 calendar days starting from the delivery date to return the goods to the seller, either for exchange or refund, at no cost other than return shipping costs.

PRICES
Prices are given in Euros.
Prices given in product descriptions do not include shipping costs.
The price given in Marie Louise de Bouteville order confirmation is the final price, with all taxes and including VAT relevant to French laws, including the cost of the goods, maintenance, packing and storing as well as shipping.

PAYMENT
Goods may be paid through Paypal or bank wire transfer to our bank. No check payable outside of the continental French territory will be accepted.
An invoice will be issued and sent to the address given by the client.

LAWSUITS
All complaints and claims will be carefully dealt with, taking into account that the client is acting in good faith, because he/she has taken his time to expose his/her claim. Considering that most of the products sold by Marie Louise de Bouteville are comestible, no claim, what so ever will be accepted due to personal taste
In the event of a lawsuit, the client will first inform the company, in an attempt to reach an amicable solution. Should this prove impossible, sole competence corresponds to the Coutances (Manche) Courts, regardless of the agreed delivery destination and means of payment.
